An Accra-based private legal practitioner, Ellis Kwame Quashigah, has initiated legal action against the Ghanaian Chronicle Newspaper, its editor, Emmanuel Akli and one McCarty Mensah, a businessman.

The defamation suit, filed at the Accra High Court, is asking for damages amounting to one million Ghana Cedis (GHC1,000.000.00).

He is also among others, seeking "aggravated damages for the reckless and malicious" publication of the newspaper, an order for the defendants to retract the defamatory statement and render an unqualified apology to the plaintiff with same prominence and circulation as the previous one.

The lawyer who is the Head of Chambers of Quashigah and Co (Dzidezi Chamber) and a Boxing Promoter, is also asking for a perpetual injunction, restraining the defendants from publishing any further defamatory material about him.

The writ issued on July 28, 2020 sighted by The Herald, mentioned Chronicle Newspaper as 1st Defendant, its editor, Emmanuel Akli 2nd Defendant and McCarthy Mensah of D.S Group Engineering Consultancy, as 3rd Defendant.

The story which captured"You have duped me, pay back my filing fee!!!" on the paper's front page of July 27, 2020, according to the Plaintiff was "malicious and "defamatory".

"Plaintiff avers that the said defamatory words were indeed, published with the sole aim of reducing the Plaintiff in the eyes of well-thinking persons in Ghana and all over the universe", part of his writ argued.

The newspaper is accused of publishing a response the Plaintiff on the heels of a petition filed at the General Legal Council by the 3rd Defendant against the Plaintiff,as though the Plaintiff granted an interview to the 1st Defendant.

The lawyer denies flatly the impression created in the story, as if he ever spoke to the 1st Defendant.

"Plaintiff has at no point in time given any response to any reporter from the 1st Defendant newspaper and that what they sought to rely upon was a response plaintiff gave in a reaction to General Legal Council query where the 3rd Defendant had gone to Lodge a petition for which the case is still pending at the General Legal Council", the lawyer noted in his writ.

Lawyer Quashigah, said the paper made no effort to do a balance report by cross-checking or contacting him for his side of the issue as required of a seasoned journalist, hence the suit for the Defendants to make their case in court.

The case was filed for Ellis Kwame Quashigah by Albert Quashigah of Kasser Law Firm.

The particulars of the defamation is that the publication sought to paint the plaintiff as lawyer of many years standing as a fraudster, or has fraudulent character who indulges in deception which is the effect of the claim that, he duped McCarthy Mensah, hence cannot be trusted as a lawyer, since he is full of acts of trickery.
